Horn Wright, LLP Wins $928,000 Verdict for Victim of Motor Vehicle Accident

Attorney Ron F. Wright of Horn Wright, LLP recently recovered a $928,000 jury verdict on behalf of a woman who suffered severe back injuries in a motor vehicle collision with a vehicle operated by an employee of Power & Construction Group, Inc. in Victor, New York. The verdict was returned after a six-day trial in which the jury deliberated on various issues, including serious injury, causation, and damages.

On September 30, 2014, our client, a 53-year-old woman and senior engineering technician for the state of New York, was rear-ended by a Power & Construction Group, Inc. vehicle. Our client alleged that she suffered lumbar spine injuries as a result of the accident and began receiving chiropractic treatments more than a month and a half after the accident. Eventually, she underwent one-level L2-3 lumbar fusion, which ultimately prevented her from returning to her state senior engineering technician job.

In the case—Arlisa Mays v. Tyler Lee Green, Power & Construction Group, Inc., Livingston Associates, LLC—the defendant claimed that our client’s lumbar spine injury was a preexisting condition, using her past complaints of lumbar spine pain in the months before the accident, her prior lumbar spine fusion surgery, and her longstanding diagnoses of lupus, diabetes, and fibromyalgia as evidence. The defendant offered our client $50,000 to settle before trial; our client had a $262,000 workers’ compensation lien and demanded $1,250,000.

Attorney Wright was able to effectively argue against the defendant’s claims and, after the six-day trial, held in the Monroe County Supreme Court, the presiding judge handed down the $928,000 verdict in favor of our client.
